IL Governor Suspends Service of Garnishment Summonses

Illinois Governor J.B. Pritzker suspends the service of wage deduction and garnishment summonses. What this means for you and why bankruptcy with Geraci Law might be a great option.

IL Governor Suspends Service of Garnishment Summonses

Governor J.B. Pritzker issued an executive order suspending the service of garnishment summonses, wage deduction summonses and citations to discover assets for consumers. This suspension is for the duration of the Gubernatorial Disaster Proclamation.

This means creditors in ILLINOIS cannot serve wage garnishment summons. It’s important to understand this is TEMPORARY. During COVID-19, the creditors are kept at bay. But creditors will be able to collect in the future. Plan for YOUR future. Consider your bankruptcy options now. Stop the creditor action before it even starts (or resumes).

Governor Pritzker has your back for now but when the suspension is lifted, these creditors WILL be back. Filing a Chapter 7 or a Chapter 13 will STOP the collections. Want to know your options? Geraci Law is open and filing bankruptcy cases. Give us a call to figure out a plan for your financial future.

Geraci Law is Here to Help

Geraci Law thanks ALL essential workers for helping everyone. If you need help, Geraci Law is here for you.

Geraci Law is Here to Help

Geraci Law wants to thank all the medical workers, grocery workers, and everyone out there working to support the country during COVID-19. We understand it’s tough and we appreciate everything you are doing.

Despite many people losing jobs, losing hours, the collection efforts do not stop. Collection agencies are still calling although they probably should not be, there are still lawsuits being filed against people who are struggling. That’s where Geraci Law can help. Filing for bankruptcy can STOP the collection actions from the creditors.

Creditor lobby groups fought against a bill proposed in Congress to STOP collection agencies from reporting late or missed payments to the three credit bureaus. The bill did NOT pass. The CARES Act did pass. There are guidelines written out by Consumer Financial Protection Bureau urging banks to work with consumers. Read more at the New York Post here. An excerpt from the letter written by US Chamber of Commerce and other associations that represent banks and creditors said,

As you consider options to protect consumers from harm, please be aware that blanket suppression of all adverse information in credit reports could disrupt consumer access to credit in the future.

Sometimes we all need a little bit of help. As of now, the help is not coming from Congress and help is not guaranteed from your creditors and banks. Geraci Law is here for you. Bankruptcy could be the solution to your problem.

If you are struggling with payments, worried about your job, worried about catching coronavirus and missing work – we’re here for you. Geraci Law IS open and meeting via video. We make debt relief simple because no one needs extra stress right now.

Virus Stimulus Package – Bankruptcy

Geraci Law helps answer questions about the Virus Stimulus Backage.

Virus Stimulus Package – Bankruptcy

The United States Government is close to authorizing a stimulus package where Americans will receive a check. How much are you expecting? What do you do with the money? Geraci Law is here to help.

If the bill passes, if you are:

  • Single and making less than $75,000 per year, you will receive $1,200 check.
  • Married and household income less than $150,000, you will receive a $2,400 check.
  • Any couples or individuals UNDER this earnings mark will receive $500 per child.

The income threshold will be based on your Adjusted Gross Income (AGI). So what do you do with the money? You should think about your finances. Ask yourselves these questions:

  • Will this money pay off my debt in full?
  • Will this additional income pay off my mortgage arrears in full?
  • Does putting this money toward my debt SOLVE my problem or just buy me another month without collection calls?

Think about your answers. You do not want a Band-Aid for a wound. This stimulus package is supposed to help cover the short paycheck or missed hours at work. If you are NOT paying off your debt balances in full, then what happens in the next month or the following with your minimums? Does this prevent a foreclosure? Does it stop a car repossession?

Bankruptcy DOES. Filing a Chapter 7 to eliminate your credit card and other debt could allow you to get back on track. The additional funds could help start a savings plan for an emergency. Filing a Chapter 13 would STOP a repossession or a foreclosure.

Geraci Law is here for you. If you have questions or if you want to talk to a professional about your financial situation, we’re here. Geraci Law is open and ready to help!
